LIA Board Meeting
November 11, 2009
The regular meeting of the Board of Directors
of Lake Iroquois Association convened at the clubhouse on
Wednesday,
November 11, 2009. The meeting was called to order by President Aders
at 7:06 pm. In
attendance: Aders, Rodriquez, Widmer, Garbaciak, Martinez,
Ostrowski and Popa. There were 8
members also in attendance.
The
Board opened the meeting with the Pledge of Allegiance. President
Aders then asked for a moment
of silence for our troops, both past
and present.
Garbaciak moved, seconded by Martinez to approve
the minutes of the October Board meeting minutes.
Motion carried.
Correspondence:
The Board thanked the Women.s Club for
sponsoring the Kids Halloween Party. Popa reported that it
was a great
success and planned to do it again next year.
Letter from Kathy
& Bob Crasby re: Impact fee. Issue tabled for further study.
Finance:
Rodriquez
From October 14, 2009 - November 10, 2009 disbursements
totaled $21,058.72. Disbursements include
$8333.32 to ERH which is
our new payment for our water/wastewater service company.
A
copy of the proposed revisions to the 2009/2010 budget was presented
and discussed.
Garbaciak moved, seconded by Widmer to approve
the new budget proposal. Motion carried.
As of October 31, 2009,
LIA has $721,780.31 in recorded assets.
The Budget-vs-Actual
report for April 1, 2009 -October 31, 2009 shows $308,593.63 in Total
Income
and $231,038.95 in Total Expense. The budget figures on this
report reflect the proposed changes as
discussed above.
Financial
reports are available for review by any member of LIA at the LIA Office
upon request.

Garbaciak moved, seconded by Popa to accept
the financial report. Motion carried.
Motion by Widmer, seconded
by Rodriquez, to increase Umbrella Insurance from $4,000,000.00 to
$5,000,000.00, a premium increase of $750.00 a year. Motion carried.
Recreation: Ostrowski
Work at pool house is on-going.
Still checking on what is needed to replace diving board.

by Rodriquez, seconded by Popa to accept the recreation report. Motion
carried.
Roads & Buildings: Widmer
New Permits issued:

Variance requests: None
Other issues:
1. Vince
Rogers property - Lot 11B: After meeting with Martensen &
Niemann, it was
obvious that they could do no more for us; therefore,
I referred the matter to Iroquois County
Planning and Zoning. I talked
to Gloria Schleef about this matter. She sent their inspector,
with
whom I met with at the site. I gave them a set of pictures of the
structure. Attached is
the correspondence from their office. If all
goes well, the building will be condemned and
torn down.
2. Detached
structure classifications. As I understand the codes, any structure
over 144sq ft will
meet the same guidelines as the house, e.g. footings,
foundations, concrete, etc.
3. CR300N: I have requested that Loda
Township correct drainage problems that exist on the
north side of
300N, to no avail. I am requesting that a letter be sent to the road
commissioner
from the board asking when this problem will be corrected.

Motion by Martinez, seconded by Garbaciak to
send a letter from the Board to Loda Township Road
Commissioner for
help with this drainage problem. 5 yeas, 1 abstention (Rodriquez)
4. Grays Bill. The Board needs to make a decision on Grays Material
Service and whether to pay or not
pay. Item was budgeted, pay the
bill.
5. Lot 708 east to Iroquois Trail. Needs to be addressed because
of standing water. Also pile of brush on
the lot that needs to be
removed. Getting a bid to correct problem up to $500.
Motion by Garbaciak
, seconded by Martinez to get a bid to correct problem, up to $500.

carried.
6. Lot 493B & 494B 1/2 status: I have
been in contact with the individuals involved and expect work to
start
within a week.
7. Projects currently being worked on: Retaining posts
are being replaced as needed, which could be as
many as 50. The fix
is temporary and must be addresses when a plan for replacement is
drafted. Bulk
head for sand retention is also in process inside the
storage building. Clean up has started with the
removal of Mark Webster.s
lawn mower, washer, dryer and misc other items belonging to Mr.
Webster.
The sludge trailer was also completely full of items belonging mostly
to Mr. Webster. I
believe that Mr. Webster should be held accountable
for the expenses incurred by LIA in the removal
of said property belonging
to him. The trailer had to go to Hoopeston to dump because of various
items disposed of in the trailer. Outside cleanup has also started.
(The Board took no action to charge
Mark Webster for the disposal
of his property. He had exceeded the deadline given to him to remove
said items himself).
8. Cleanup of LIA facilities. Attached are pictures
of problems areas. I would like to remind the board
that we are the
caretakers of all LIA facilities and equipment. It is very obvious
that some of LIA.s
facilities and equipment are in dire need of repair
and a maintenance program established.
9. Abandoned boats, trailers,
docks, etc located behind the burn pile. Boat numbers & serial
numbers
have been given to security to locate owners so they can remove
their property from LIA premises.
10. We have a considerable amount
of work to be done with getting ready for winter. This weather will
not stay this way for very long. We need to address the hours maintenance
is putting in.
11. Since we have been using salt mixed with sand,
I requested our engineering firm to recommend an
acceptable mix of
salt & sand, so we do not damage our oil-chip roads.
At
this time Widmer left the meeting.

Water-Wastewater: Garbaciak
Last month
we pumped 1,140,300 gallons of water 287,740 gallons less than last
month and 191,690
gallons less than last year - still trending
good.
Water tower completion and warning light - ladder
will be shipped on Friday Nov 15. When it arrives it
will be installed
and some outstanding items (Foth.s "punch list") will be addressed.
Also the new L.E.D.
warning light will be installed. Hopefully this
work will be completed the week of the 23rd and our
project will be
finished.
We have received from ERH their monthly report on
water/wastewater systems and analysis of our
readings (testing &
chemicals). All are in satisfactory amounts.
Also they included
24 items that have been or are being addressed by them. I will highlight
them for this
report -the complete list is available at the LIA office
for your review.
They have painted buildings and fixtures, installed
a new building at the sewer plant and repaired our
final filter building.
They have repaired the several electrical motors in our water and
sewer plants and
they also repaired the electrical wiring -switches
and controls at our plants. Cleaned our drying beds
twice. They are
also in the process of repairing our sludge traveler system in our
sewage digester. They
are in the process of installing our sense-phones
at the lift stations. Again, this complete report is
available at
the LIA office for your review.

New water
plant - We have received word on our new water/wastewater plants.
EPA was requiring a few
changes to the bidding documents in the project
manual. Shive-Hattery did the changes and reprinting.
They had no
comment on the drawings, so we believe that they are approved (?).
David Shafer touched base with us. His comment: Water plant
looks like we should see a permit in the
next few weeks. They have
had a few phone calls to clear up outstanding questions so they believe
that
we are close. The will prepare forms to request the authorization
to bid.
Sewer plant - They think we are still a little
way away. We believe we have met all of the EPAs
requirements, but
they do not have a feeling for a time line to receive a permit.
Side
note -Several contractors have shown significant interest in our projects.

Discussion
was had regarding the possibility of purchasing a severe weather warning
system: $20,000 +
installation. Will approach Bales Lake about whether
they would be interested in splitting the cost and
locating between
the lakes. Will do more research.

Garbaciak to accept Security Report. Motion carried.
Facilities
Operations Manager:
Steve Reynolds has been working on repair
of the cable guardrail along Iroquois Trail and has winterized
all
equipment as well as fixed the salt spreader.
Gator needs to
be serviced. Martinez will get estimates.
Old Business:
The
Board chose not to put any speed bumps at the back gate over winter
month.
Revised guidelines for unlicensed vehicle usage and unlicensed
drivers;
Unlicensed Drivers:
Unlicensed drivers may drive
unlicensed vehicles on LIA streets under certain conditions.
Each
item was presented as a motion:
1. Operators must be 12 years
of age or older and must be the members. immediate family or
guest.
Carried
2. Operators along with their parent, grandparent or
guardian must have attended and
successfully completed an LIA rules
and safety course for unlicensed vehicles. Carried
3. Operators must obey all driving rules, such as keeping to
the right side of the road, no kicking
up gravel, staying off lawns
and empty lots, and obeying the 25MPH maximum speed limit
on LIA roadways.
Operators must recognize that all pedestrians have the right of way.
Carried
4. Riders must wear safety helmets. Golf carts are exempt
from the helmet requirement. Carried
5. Unlicensed
vehicles must conform to the LIA unlicensed vehicle rules. 4 yeas,
1 nay (Rodriquez - voted no due to points #5 and #6 under "Unlicensed
vehicles" below)
6. Immediate family members under the age of
12 may drive unlicensed vehicles on LIA trails
only when in the immediate
control of a parent, grandparent or guardian who is a member of
Lake
Iroquois. Immediate control is defined as being within normal speaking
distance. Carried.
Unlicensed Vehicles:
Association
members, immediate family and guests may operate All Terrain Vehicles,
Golf Carts, Go
Carts and unlicensed motorcycles on LIA streets and
roadways under the following conditions:
1. A current certificate
of liability insurance and a signed letter of understanding from the
owner
must be on file. The unlicensed vehicle must be registered with
LIA. Carried
2. Vehicles may only be operated on
LIA streets or designated areas. Carried
3. Vehicles
must display a bright orange safety flag which is visible above the
rider, occupants
or roof line of the unlicensed vehicle.
Carried
4. Vehicles must obey all driving rules, such as keeping
to the right side of the road, no kicking
up gravel, staying off lawns
and empty lots, and obeying the 25MPH speed limit on LIA
roadways.

7. Vehicles operating between sunset
and sunrise must have illuminated white headlamps
visible 500 feet
to the front and illuminated red taillights visible 100 feet to the
rear. Carried
New Business:
The Board will address
updating Rules and Regulations handbook and the LIA website in the
future.
